1. Agreement to Terms

By accessing or using the Medcare Telehealth website at medcaretelehealth.org (the "Site") and any services offered through it (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Site or Services.

These Terms constitute a legally binding agreement between you and Medcare ("we," "us," or "our"). Your use of the Site or Services signifies your acceptance of these Terms.

2. About Medcare

Medcare is an independent telehealth healthcare provider that helps Medicare patients access preventive care, including Annual Wellness Visits and Community Health Integration services, from home by telephone or secure video.

Medcare is not Medicare, Medicaid, CMS, a government agency, an insurance company, or a government assistance program. We do not administer, determine, or guarantee any government benefits.

3. Use of Our Services

You may use our Site and Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local laws or regulations
  • Submit false, inaccurate, or misleading information when using our eligibility checker or scheduling tools
  • Attempt to gain unauthorized access to any part of the Site, its systems, or data
  • Use the Site to solicit, harass, or harm any other person
  • Interfere with or disrupt the operation of the Site or Services
  • Use any automated tools, bots, or scrapers to access the Site without our prior written permission

You are responsible for maintaining the confidentiality of any information you share through the Site and for all activities that occur under your use of the Site.

4. Eligibility Checks

Our Site offers an online eligibility checker that allows you to check whether you may be eligible for a Medicare Annual Wellness Visit. When you use this tool, you must provide accurate information, including your first name, last name, and date of birth.

Your consent is required before we perform any eligibility check. The results of the eligibility check are based on information available at the time of the check and may change. A result indicating eligibility does not guarantee that Medicare will cover any specific service or that a clinician will determine that a service is medically appropriate for you.

Eligibility check results are for informational purposes only and do not constitute a guarantee of coverage, benefits, or services.

5. Scheduling and Appointments

Our Site allows you to request an appointment with a licensed clinician. Submitting a scheduling request does not guarantee an appointment. Our team will contact you to confirm availability and schedule your visit.

You agree to provide accurate contact information when scheduling so we can reach you to confirm your appointment. You are responsible for being available at the scheduled time or notifying us in advance if you need to reschedule.

6. Telehealth Services

Telehealth services are provided by licensed clinicians via telephone or secure video. Telehealth services may not be appropriate for all medical conditions and are not a substitute for in-person care when medically necessary.

You understand and agree that:

  • Telehealth services may not be available in all areas or at all times
  • Technology failures may interrupt or prevent a telehealth visit
  • A clinician may determine that your condition requires in-person care, emergency services, or referral to another provider
  • Telehealth rules and Medicare coverage for telehealth may change and depend on the service, date, patient location, and current CMS policy

If you are experiencing a medical emergency, call 911 or seek immediate emergency care. Medcare is not an emergency service.

7. No Guarantee of Eligibility or Benefits

Medcare does not guarantee eligibility, insurance coverage, financial assistance, community benefits, or specific clinical outcomes. Medicare coverage, telehealth rules, cost sharing, and Community Health Integration requirements are determined by CMS, Medicare, and your specific plan, not by Medcare.

Any information provided on our Site, through our eligibility checker, or during a telehealth visit regarding potential benefits or services is for informational purposes only and is not a promise or guarantee of any particular result.

8. Not a Government Agency

Medcare is an independent healthcare provider. We are not affiliated with, endorsed by, or connected to Medicare, Medicaid, CMS, the federal government, any state government, or any government assistance program.

We do not determine eligibility for government programs, distribute government benefits, or make funding decisions. Any assistance we may provide in connecting you with community resources is informational only, and each outside organization makes its own eligibility and funding decisions.

9. Intellectual Property

The Site and its content, including text, graphics, logos, images, and software, are the property of Medcare or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written permission.

You may view and use the Site for your personal, non-commercial purposes only.

11. Limitation of Liability

To the fullest extent permitted by law, Medcare and its affiliates, officers, employees, clinicians, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of or inability to use the Site or Services, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from or related to the Site or Services shall not exceed the amount you paid us, if any, for the specific service giving rise to the claim.

This limitation does not apply to liability that cannot be limited under applicable law, including liability for gross negligence or willful misconduct in the provision of healthcare services.
