Medcare may request information reasonably necessary to identify the accessibility issue and determine an appropriate response.
Do not submit emergency medical requests through an accessibility request.
13. Accessibility Requests Involving Health Information
An accessibility request does not automatically authorize disclosure of a patient's medical information to another person.
If another individual is assisting a patient, access to Protected Health Information may remain subject to:
- HIPAA;
- Applicable state law;
- Patient authorization;
- Parental authority;
- Guardianship;
- Personal representative status;
- Other applicable privacy requirements.
Accessibility assistance and authorization to access medical information are separate matters.
14. No Retaliation
Medcare will not discriminate or retaliate against an individual for making a good-faith request for an accessibility accommodation or reporting an accessibility concern where such activity is protected by applicable law.
15. Nondiscrimination
